[p. 157] This indenture made 5th January 1822 between William Moore of the Borough of Reading late merchant of the one part, and George D. B. Keim of the same place and William Moore of Lebanon in Co. of Lebanon of the other part. Whereas William Moore of Reading on the day of the date hereof is justly indebted to divers persons in considerable sums of money which by reason of diverse losses & misfortunes heretofore incurred and suffered he is not able fully to pay and satisfy And whereas the same William Moore has agreed and resolved to transfer and assign all his estate real personal and mixed in trust for the use of his creditors Now this Indenture witnesseth that the said William Moore of Reading for and towards making payment & satisfaction to his creditors and for the further consideration of one dollar by them the aforesaid George D.B. Keim and William Moore of Lebanon to him the said William Moore of Reading in hand paid at and before the ensealing and delivery of these presents the receipt they do hereby acknowledge Has granted...unto...George D.B. Keim and William Moore and their heirs and assigns [1] a lot of ground situate on the south side of Penn Street in the Borough of Reading being the same on which William Moore lived for many years [2] Also one half of three fourths of a lot of ground in the Borough aforesaid with a frame building thereon erected and now in the tenant[?] of George Dillor [3] Two lots of ground in the Borough of Reading commonly called Hockleys out lots containing each five acres subject to a certain ground rent [p. 158] [4] Also a tract of wood land situated in Robeson and Cumru Townships in the County of Berks containing 468 acres [5] Also one half of two tracts of wood land in Alsace Township containing about 40 acres / the title deed whereof is in the name of Frederick Hellor Esquire and is subject to an encumbrance of $400 to the office of discount and deposit in Reading [6] One lot of ground in the town of Sunbury in the County of Northumberland being No. 75 containing in breadth on Broadway 57 feet 6 inches and in length to Barberry Alley 230 feet. [7] One lot of land in the town of Lebanon in the County of Lebanon being numbered in the plan of said town No. 297. [8] Three tracts and one third of unimproved land in Centre County containing 3473 acres and 123 perches. [9] Also 13 acres and an half of land being out lots in the Borough of Reading. [10] Also all the other real estate of William Moore whereever situate and whatsoever description may be Together with all improvements... And William Moore does also for the considerations before mentioned grant to George D.B. Keim and William Moore all the goods and merchandize now remaining in his hands which he saved at the time his house was destroyed by fire (excepting nevertheless his necessary household goods bedding etc.) Also one share of the Bank of Pennsylvania and twenty shares of the Farmers Bank of Reading Also five shares of the Reading and Perkiomen Turnpike Six shares in the Centre turnpike and two shares of stock of the Northumberland Bridge one chair and harness, one sleigh, two horses, one cow, one small wagon, one cart, one plough and harrow. Also all the bonds notes and book debts of him the said William Moore amounting in the whole to $14,982.74 parts of good and bad debts. To have and to hold ... In trust nevertheless that the said George and William or the survivor of them do forthwith take possession of all and singular the real personal estate aforesaid and to sell and dispose of for the best prices that can be obtained either by public or private sale and to collect as soon as possible all the debts owing to William Moore [p. 159] and after deducting the costs and expenses of this trust and a reasonable compensation for executing the same to dispose of the whole proceeds as follows First whereas John Reynolds of the City of Lancaster did some time ago obtain from the said Wm Moore order on the assigns of the estate of David Moore of Chester County for such sum of money as the said William Moore should be entitled to out of the estate of the sd David Moore being estimated at the sum of $4000 dollars And whereas it is apprehended that the said sum of $4000 will not be recoverable out of the estate aforesaid the trustees aforesaid are therefore first to pay to John Reynolds his heirs or assigns such sum as shall be required to make up the $4000 with the sum which he has received or shall receive out of the Estate of David Moore on the order aforesaid. Secondly after the payment as aforesaid to John Reynolds, the whole of the residue which shall in the hands of the trustees aforesaid shall be by them or the survivor of them paid to all the creditors of William Moore pro rata or in proportion to respective demands of each creditor. Thirdly if there shall be any residue...the same is to be paid to William Moore his executors or administrator.
